I bought a 39A around 2007 and It wouldn't extract shells and the rebounding hammer would misfire often. That drove me nuts because it is a tack driver and what good is a rifle that only works part time.
If I had known of the changes Marlin had done I would of shopped for a used older one. Marlin sent me a new extractor shortly after I bought it but it was a spring steel one with the same issues. So I purchased a old model extractor and that issue went away. Then I ground off the rebound lobe and that stopped the misfires but the hammer fall was loud and the half cock notch didn't hold so you had to depend on the cross bolt safety.
Well I finally found a old style hammer and trigger, spring and the flat bar that the spring mounts on for the hammer and installed them. My cross bolt safety no longer works but my half cock is nice and deep so I don't need the cross bolt. I bought a delete for the safety that is too long for a 39A so I will leave it in.
Test fired it today and everything works well like they did 50 years ago. Lawyers have caused some inconveniences!

I'm glad that you found the answer to the lawyer induced problems, it's always worth looking at old parts that do the job that the original designer designed....
I have some old Cooey 84 parts that fit my recent acquisition Winchester 37a should I need them.
