Success can be as trying as failure

One of my cases that I won in the Fifth Circuit Court of Appeals was recently granted cert in the United States Supreme Court. If has been my dream for many years to argue before the Court, so I saw this as a very good thing and an opportunity.

BUT, you would think that I did something to the punch bowl and the way my colleagues have reacted. I have been praying for the strength to keep on the right path for my clients and ignore the noise. Pray with me if you would. I know that this is to teach me something and I’m looking forward to understanding it better.

Scott, sounds like you're in a fight for true justice to prevail towards what is right & good, so yes I pray for you and client's!

What is the case name?
Gonzalez v. Trevino. But some of what you read about this case is really slanted. The officer did a thorough investigation and took it to a judge who issued a warrant. Normally that would be a good basis for an arrest. Thorough investigation and an independent finding of probable cause should entitle an officer to qualified immunity.

Scott, I have to ask.

It's my understanding that to present an argument in front of SCOTUS a lawyer has to be certified to present to them. Are you already certified or is there something special that you have to do to qualify?

Steve, if you'll google his name, you will find that Scott is eminently qualified to take cases all the way to the United States Supreme Court.

You have to be admitted to practice before the Court. I’ve been admitted to practice for several years. But I haven’t actually argued a case there as most are denied cert.

Yes, that was my brief at the cert stage.

I’m going to DC next week for a meeting with the Solicitor General. Interesting to engage in this process.

However, it seems from your brief that you have a strong argument with compelling facts so I'm a bit surprised that it has gone this far.

I was too. But they need to clarify something about Nieves and I think that’s where they are going.
