OT Is a covered holster concealed carry?

Post by TomD »

I know it is a kinda crazy question. On the one hand a holster in full relief, even if you can hardly see the gun quite likely no more evident than a lot of concealed carry, it is obvious that you have a honking big holster there, and what you have in it, unless you are bluffing.

On the other hand, an LEO wanting to pin a concealed weapons charge on a knife owner, or gun owner has tried crazier things before.

The only case where it might be useful would be in a state that has friendly laws on concealed carry, but is not open to open carry.

It depends entirely on your state laws. In the early versions of Texas CHL laws, to be concealed it had to not be distinguishable as a firearm. In other words, "printing" meant your firearm was not concealed. A couple of legislative session ago they relaxed the laws to where an inadvertent exposure of the handgun was no longer a crime (i.e. lifting your arms up, causing your shirt to lift to the point your handgun became momentarily visable).
As of Jan 2016, fortunately none of that is an issue for us, as our CHLs become HLs :D

In Virginia, the law states, "A weapon shall be deemed to be hidden from common observation when it is observable but is of such deceptive appearance as to disguise the weapon's true nature."

However, open carry is legal in VA, so it doesn't matter if it is in a covered holster.

Check your state laws.
